The overall top 40 list was compiled based on a study of 55 law faculties, as well as all student bodies. The 55 faculties to be studied were chosen based on successful performance in the 1998 study printed in the 2000 Journal of Legal Studies, quality of student body, and/or post-1998 evidence that the school might compete successfully for the top 40. The list of law faculties studied were:

Likely to be added for the next study, based on preliminary indicators of potentially competitive ranking, are: Temple University and University of Missouri-Columbia.
